Resumo: O ingresso de estudantes surdos no ensino superior tem ampliado nos últimos anos, e com isso, a inclusão desses estudantes, passa a ser um desafio. Nesse sentido, objetivamos neste estudo analisar a sua inclusão no ensino superior em Portugal. O estudo compreende a trajetória de três estudantes surdos vinculados a duas instituições de ensino superior, e cuja comunicação se estabelece pela Língua Portuguesa. Como forma de levantamento de dados, foram realizadas entrevistas semiestruradas, nas modalidades presencial e por videoconferência. Salientamos (...) que a escolha pela língua oral utilizada durante a entrevista foi dos estudantes, uma vez que estes alunos utilizam na maior parte do seu tempo a Língua Portuguesa, na sua vertente oral e escrita. Os resultados apontam para a importância de repensar a oferta de ensino permeado pela presença da Língua Gestual Portuguesa (LGP) nas atividades acadêmicas tendo em conta as principais necessidades apontadas pelos estudantes que participaram neste estudo: a) presença do intérprete de LGP nas salas de aula; b) colaboração dos professores da educação superior; c) interações sociais na universidade, e d) inclusão de estudantes surdos, o que demonstra a importância de repensar as práticas inclusivas para estudantes universitários surdos nas Instituições que frequentam. Deaf students in Higher Education in Portugal - a reflection on inclusion Abstract: The enrollment of deaf students in higher education has increased in recent years, and with that, the inclusion of these students, becomes a challenge. In this sense, we aim in this study to analyze its inclusion in higher education in Portugal. The study comprises the trajectory of three deaf students linked to two higher education institutions, and whose communication is established by the Portuguese Language. For data collection, semi-structured interviews were conducted, in person and by video conference. We emphasize that the choice of the oral language used during the interview was of the students, since these students use most of their time the Portuguese language, in its oral and written components. The results point to the importance of rethinking the teaching offer permeated by the presence of the Portuguese Sign Language (PSL) in academic activities taking into account the main needs pointed out by the students who participated in this study: a) presence of the PSL interpreter in the classroom; b) collaboration of higher education teachers; c) social interactions at the university, and d) inclusion of deaf students, which demonstrates the importance of rethinking inclusive practices for deaf students in the Institutions they attend. En este sentido, nuestro objetivo en este estudio es analizar su inclusión en la educación superior en Portugal. El estudio comprende la trayectoria de tres estudiantes sordos vinculados a dos instituciones de educación superior, cuya comunicación está establecida por la lengua portuguesa. Como medio de recopilación de datos, se realizaron entrevistas semiestructuradas, en persona y por videoconferencia. Destacamos que la elección del idioma portugués utilizado durante la entrevista fue de los estudiantes, ya que estos estudiantes utilizan la mayor parte de su tiempo el idioma portugués, en sus aspectos oral y escrito. Los resultados apuntan a la importancia de repensar la oferta docente permeada por la presencia de la Lengua de Signos Portuguesa (LSP) en las actividades académicas teniendo en cuenta las principales necesidades señaladas por los estudiantes que participaron en este estudio: a) presencia del intérprete LSP en las aulas; b) colaboración de profesores de educación superior; c) interacciones sociales en la universidad, y d) inclusión de estudiantes sordos, lo que demuestra la importancia de repensar las prácticas inclusivas para los estudiantes universitarios sordos en las Instituciones a las que asisten. The historical formation of Brazil is distinguished from the majority of ex-colonial nations by one factor that is especially characteristic: an intense process of ethnic and cultural mixing. The Portuguese colonisers, who, unlike the English Puritans in North America, left their families and arrived in Brazil in small groups mainly composed of men, naturally tended to pair off with the women they found available - first of all indigenous women and later African women. There was nothing in Brazil to prevent (...) this spontaneous behaviour similar to the role played in the English colonies of North America by the strength of the family group or the strict religious observance of the community. Thus from the outset Brazil tended to accept racial mixing as a de facto reality. As Gilberto Freyre correctly noted in his book Casa Grande e Senzala:They mixed happily with women of colour from the very first contacts and many mixed-race children resulted, so much so that only a few thousand men were enough to colonize vast areas and compete with the greatest and most numerous peoples as regards the extent of the colonial territory and the effectiveness of colonizing activity. This article develops a conceptual framework for regulating Artificial Intelligence (AI) that encompasses all stages of modern public policy-making, from the basics to a sustainable governance. Based on a vast systematic review of the literature on Artificial Intelligence Regulation (AIR) published between 2010 and 2020, a dispersed body of knowledge loosely centred around the “framework” concept was organised, described, and pictured for better understanding. The resulting integrative framework encapsulates 21 prior depictions of the policy-making process, aiming to achieve gold-standard societal (...) values, such as fairness, freedom and long-term sustainability. This challenge of integrating the AIR literature was matched by the identification of a structural common ground among different approaches. The AIR framework results from an effort to identify and later analytically deduce synthetic, and generic tool for a country-specific, stakeholder-aware analysis of AIR matters. Theories and principles as diverse as Agile and Ethics were combined in the “AIR framework”, which provides a conceptual lens for societies to think collectively and make informed policy decisions related to what, when, and how the uses and applications of AI should be regulated. Moreover, the AIR framework serves as a theoretically sound starting point for endeavours related to AI regulation, from legislation to research and development. As we know, the (potential) impacts of AI on society are immense, and therefore the discourses, social negotiations, and applications of this technology should be guided by common grounds based on contemporary governance techniques, and social values legitimated via dialogue and scientific research. ABSTRACT This text is theoretical and seeks to achieve a double objective. First, it aims to contribute to a more solid understanding of the theory of value derived from the thought of the Genevan linguist Ferdinand de Saussure. To do so, it presents the three different types of value that, according to Bouquet (2004), are included in the Saussurean theory: the value relative to the internal element, the value relative to the systemic element, and, finally, the value relative to the (...) discursive element. Second, this text tries to make the theory of social evaluation in the word known, at least in part, as proposed by the Russian thinker Valentin N. Vološinov. For this purpose, based on Gomes (2023), it seeks to present three key points to understanding this theory: the distinction between meaning and social evaluation, the relationship between social evaluation and the creative character of language, and, finally, the relationship between social evaluation and historical becoming. Este trabalho tem como objetivo refletir sobre a importância da educação para a informação em diferentes contextos e etapas da vida humana, com vistas à consolidação da aplicação prática e democratização da competência em informação na sociedade brasileira, que, ainda, carece de atenção e novos esforços. Apoiadas na literatura da Ciências da Informação e áreas afins, a exemplo de Kuhlthau (2001), ACRL(2016), Belluzzo (2017), Dudziak (2005, 2016), Pereira e Alcará (2020), Menze (1981) e Le Boterf (2000, 1982), as reflexões apresentadas (...) apontam que, considerando a igualdade de oportunidades educacionais para todos, a educação para a competência em informação precisa ser ofertada em instituições educativas, culturais e sociais, responsáveis pela promoção da educação relativa à formação dos indivíduos. Esta ainda não possibilita a todas as pessoas a oportunidade de acesso à educação para a informação na etapa da vida e contexto social em que se encontram, o que constitui um exemplo de uma realidade social injusta; que nega um direito humano básico. Este artigo traduz a discussão que vem sendo construída sobre a indumentária étnica, especificamente de matriz afro-brasileira. Para tal narrativa, a temática envereda-se em apresentar alguns artefatos pertencentes à Coleção Perseverança: faixa, peitoral, coroa capacete, pulseiras e bolsas. Esta pesquisa seleciona, dentre as 215 peças da coleção, os adornos utilizados nos terreiros de Xangôs do estado de Alagoas. É importante entendermos que os artefatos selecionados representam a memória do “Quebra do Xangô”, em 1912, ato conhecido como a invasão e destruição (...) de todos os terreiros nas cidades alagoanas, principalmente a capital Maceió. A Perseverança nasce nesse contexto, representando, além do fato que lhe deu origem, a cultura africana presente no estado. Ainda que a linguagem cinematográfica seja diferente da filosófica, os diversos gêneros do cinema podem apresentar distintas formas da realidade humana de modo crítico e conciso. Esse seria o caso do cinema catástrofe, no qual são evidenciadas questões fundamentais, como a relação entre homem e natureza, mostrada, por exemplo, no filme “The Day After Tomorrow”, de (...) O presente artigo tem como objetivo o estudo da ética da compaixão em Arthur Schopenhauer para que possamos chegar a um conceito de alteridade na sua filosofia. O ponto de partida é a concepção metafísica do mundo como Vontade e Representação, a partir do qual consideramos as possibilidades de uma ética não prescritiva, diferentemente de Kant, em que o reconhecimento do “outro” e da “Vontade” como coisa-em-si apresenta-se como o melhor caminho para as ações morais do homem, no sentido em (...) que este pode elevar-se à condição de “Bondade”, descrita por Schopenhauer sob as bases da “compaixão” e “Alteridade”. The transition and adaptation of students to higher education involve a wide range of challenges that justify some institutional practices promoting skills that enable students to increase their autonomy and to face the difficulties experienced. The requirements for this adaptation were particularly aggravated by the containment and sanitary conditions associated with coronavirus disease 2019. With the aim of promoting academic success and preventing dropout in the first year, a support program was implemented for students enrolled in two courses in the (...) area of education at a public university in northern Portugal during the first semester of 2020/2021. Three sessions of 50/60 min were implemented, namely, the first session focused on the verbalization of the demands, challenges, and difficulties of the transition, and the second and third sessions focused on the difficulties of academic adaptation and academic performance. Data from a dropout risk screening instrument and from the activities performed during sessions were analyzed. The main results point to student satisfaction with the content and the activities of the sessions and their usefulness. Students report not only high satisfaction levels with HE attendance, but also some emotional exhaustion due to academic activities. The continuity of the program is recommended with some improvements in its planning to ensure a more definitive version of the program in the next two years. (shrink)

ObjectiveThis study aims to analyze sociohistorically how the normative patterns of hegemonic masculinity produced impacts on men’s health/mental health in the context of the COVID-19 pandemic.MethodsA qualitative study from a socio-historical perspective was conducted with 50 men based on an online survey. A semistructured form was applied. The data were analyzed by the Collective Subject Discourse method, interpreted in the light of the context of epidemic disease and hegemonic masculinity.ResultsThe experience of the pandemic exposed the normative patterns of masculinities from (...) the consummation of acts representative of the pandemic context, which incited men to deny the existence of COVID-19 disease and to delay the understanding and adoption of measures to protect and control COVID-19. As a repercussion, men presented conflicts in the regulation of emotions; presented emotional suppression; were more reactive; felt threatened regarding the loss of the role of family provider, virility; and revealed a sense of invulnerability, added to the weakening of self-care.ConclusionThe discourse revealed that the men’s behaviors are consistent with the characteristics of hegemonic masculinity, but express signs of recognition that this behavior causes harm to themselves and their health. This issue has provoked debate because it touches on the ethics of research and the relationships with the people involved in these studies. This case study aimed to investigate community perception of an ethnobotany research project that was carried out in the semi-arid region of northeastern Brazil. Furthermore, we reported how the residents of this rural community felt about participating in the activities of “return” that arose from (...) the projects. Our findings demonstrate that “return” activities should be planned from the design phase of the research until its closure as a lifelong process that allows the communities involved to gradually take ownership of the information and actions that are being generated. Similarly, we argue that such activities must be negotiated with the people of the community so that they have decision-making power and autonomy to decide what is most relevant to their lives. Phenomenal particularism is the view that particular external objects are sometimes part of the phenomenal character of perceptual experience. It is a central part of naïve realist or relational views of perception. We consider a series of recent objections to phenomenal particularism and argue that naïve realism has the resources to block them. In particular, we show that these objections rest on assumptions about the nature of phenomenal character that the naïve realist will reject, and that they ignore the full (...) resources that naïve realism has to offer in explaining phenomenal character. For Kant, the human cognitive faculty has two sub-faculties: sensibility and the understanding. Each has pure forms which are necessary to us as humans: space and time for sensibility; the categories for the understanding. But Kant is careful to leave open the possibility of there being creatures like us, with both sensibility and understanding, who nevertheless have different pure forms of sensibility. They would be finite rational beings and discursive cognizers. But they would not be human. And this raises a (...) question about the pure forms of the understanding. Does Kant leave open the possibility of discursive cognizers who have different categories? Even if other discursive cognizers might not sense like us, must they at least think like us? We argue that textual and systematic considerations do not determine the answers to these questions and examine whether Kant thinks that the issue cannot be decided. Consideration of his wider views on the nature and limits of our knowledge of mind shows that Kant could indeed remain neutral on the issue but that the exact form his neutrality can take is subject to unexpected constraints. The result would be an important difference between what Kant says about discursive cognizers with other forms of sensibility and what he is in a position to say about discursive cognizers with other forms of understanding. Why is gauge symmetry so important in modern physics, given that one must eliminate it when interpreting what the theory represents? In this paper we discuss the sense in which gauge symmetry can be fruitfully applied to constrain the space of possible dynamical models in such a way that forces and charges are appropriately coupled. We review the most well-known application of this kind, known as the 'gauge argument' or 'gauge principle', discuss its difficulties, and then reconstruct the gauge argument (...) as a valid theorem in quantum theory. We then present what we take to be a better and more general gauge argument, based on Noether's second theorem in classical Lagrangian field theory, and argue that this provides a more appropriate framework for understanding how gauge symmetry helps to constrain the dynamics of physical theories. The present paper is about the author’s current research on children’s education in urban contexts. It departs from the rising offer of programmes for school children in out-of-school contexts (e.g. museums, libraries, science centres). It asks what makes these practices educational (and not just interesting, entertaining and/or audience building). Based on Biesta ( 2006a , 2010 ) theory of education, the author frames and analyses the educational characteristics of, and possibilities of articulating, in and out-of-school educational practices. This paper aims (...) at understanding if the occasional outing from primary school premises promotes interruptions in the humanist foundations of school. In order to analyse relations between different institutions and professionals (to be) engaged in educational activities and programmes, Nóvoa ( 2002 , 2009 ) essays will be brought to the discussion, namely his conception of the ‘Public Space of Education’—as a space where culture, education, arts, sports and leisure are shared responsibilities, and where diverse institutions are networked aiming towards societal pluralism. I argue for the possibility of using cities’ public spaces as contexts with a worldly quality to complexify children’s education. Nevertheless, I draw attention to the unbearable educational lightness that these practices may carry if they do not go beyond the praise of chance; as well as to their unsustainable weight if they perpetually repeat school’s normal orders and add up rational discourses. A história de O Clarim constitui-se em uma rica documentação de história da educação, pois revela um pouco das representações da cultura juvenil daquele tempo. Aqui interessam os significados da difusão dos discursos difundidos pelo periódico, nos processos de subjetivação provocados pelos textos e suas possíveis influências na construção das identidades daqueles jovens. A pesquisa identifica-se com os (...) pressupostos teóricos da História Cultural e se inscreve no campo das práticas de leitura e escrita e de memórias juvenis, tendo como referenciais as concepções de cultura escrita como uma produção discursiva de um determinado tempo e lugar. On the basis of arguments showing that none of the most influential analyses of Moore's paradox yields a successful resolution of the problem, a new analysis of it is offered. It is argued that, in attempting to render verdicts of either inconsistency or self-contradiction or self-refutation, those analyses have all failed to satisfactorily explain why a Moore-paradoxical proposition is such that it cannot be rationally believed. According to the proposed solution put forward here, a Moore-paradoxical proposition is one for which (...) the believer can have no non-overridden evidence. The arguments for this claim make use of some of Peter Klein's views on epistemic defeasibility. It is further suggested that this proposal may have important meta-epistemological implications. Identity. : This article comprises a detailed report on a project of narrative production, which is being conducted, every semester, with students entering the Languages course, on the Portuguese Language subject.The project consists of a process of production, reading, and rewriting of small narratives, which, at the end of the term, are gathered and organized by each student in order to assemble their own book craftily. The proposal came forth as a (...) strategy to try to solve problems related to the little familiarity with writing and to the lack of authorship marks. The engagement in the production of contextualized and guided narratives for a determined purpose has disclosed, at the end of each semester, similar results: pleasure to write, read and expose the produced texts for group discussions; concern with the interlocutor; presence of authorship marks; perception of discursive qualities on the text itself and on the text of others; concern with the adequacy of the writing to linguistic conventions; confidence on the writing process; perception of oneself as part of a history and as a result of multiple intersubjectivities; praise of one’s own life history and of one’s ancestors. The project finds itself based on enunciation theories. : Produção de narrativa. Autoria. Linguagem. Memória. Identidade. : Este artigo constitui-se do relato de um projeto de produção de narrativa que vem sendo desenvolvido, semestralmente, com alunos ingressantes no curso de Letras, na disciplina de Língua Portuguesa. O projeto consiste em um processo de produção, leitura e reescritura de pequenas narrativas com as quais, ao fim do semestre, cada aluno organiza e confecciona artesanalmente o seu próprio livro. A proposta surgiu como estratégia para tentar solucionar problemas relacionados à pouca familiaridade com a escrita e à ausência de marcas de autoria. O enfoque na produção de narrativas contextualizadas e orientadas para um determinado fim tem revelado, no fim de cada semestre, resultados semelhantes: prazer de escrever, de ler e de submeter à discussão do grupo os textos produzidos; preocupação com o interlocutor; presença de marcas de autoria; percepção de qualidades discursivas no próprio texto e no texto do outro; preocupação com a adequação da escrita às convenções linguísticas; segurança em relação à escrita; percepção de si como parte de uma história e como fruto de intersubjetividades múltiplas; valorização da própria história de vida e da de seus antepassados. Seven informants , aged between 32 and 42, who had experienced at least one career change in their lives were interviewed about the history of their career trajectories. The interviews were analyzed according to the systematic and systemic reflexivity proposed by the phenomenological tradition: description, reduction and interpretation. The findings point to the need for professional guidance practice giving attention not only to professional information but also to a reflection of individual and work-related values. Cet article propose un itinéraire de réflexion sur les fondements de l’éthique théologique en articulant trois contributions de Karl Barth à ce domaine : la définition de l’éthique comme l’impératif de l’indicatif qu’est la dogmatique, voire l’inséparabilité entre éthique et dogmatique qui place l’éthique à l’écoute de la révélation ; l’articulation d’un nexus christologique entre les catégories d’obéissance et de liberté comme « autodétermination déterminée » ; le débat sur l’Évangile et la Loi, comme révélation de l’histoire de la grâce (...) à partir de laquelle se déploie la grammaire d’une existence chrétienne. Cet itinéraire est entrecoupé par trois passages bibliques qui sont alignés sur les contributions de Barth : la vocation d’Abraham ; l’agonie de Jésus à Gethsémani ; la question posée à Jésus sur le bien qu’il faut faire pour entrer dans la vie éternelle. Nous suggérons que cet itinéraire biblique et barthien souligne qu’une éthique théologiquement construite conflue vers la christologie. (shrink)

Organisations are increasingly transforming themselves to remain profitable and obtain sustainable competitive advantages. Business processes are as important as technology in promoting organisational transformation. Organisational transformation ultimately entails combining existing business components, whether or not with the same use and design, with new ones to generate novel products and services. For example, one particular type of organisation transformation is digital transformation. This notion, which covers even the subjective aspects of organisational transformation, is currently under intensive discussion and suffers from the (...) semantics terms fluctuation related to the notion of ‘organisational transformation’. We argue that this topic could strongly benefit from an ontological analysis and conceptual clarification of these notions. This paper contributes with an attempt in this direction by proposing a Core Ontology of Organisational Transformation (COOT). This ontology comprises concepts and relations central to creating a reference model representing the organisational transformation paradigm. PRINCÍPIO DA COMPLEMENTARIDADE RECURSAL APÓS DECISÃO DOS EMBARGOS DE DECLARAÇÃO: GARANTIA DO CONTRADITÓRIO EM OPOSIÇÃO À PRECLUSÃO CONSUMATIVA.

This paper examines undergraduate business students' perception of corporate social responsibility in cases in which they have not attended any specific course either dealing with CSR or providing training in ethics. A survey was conducted of 535 Spanish business students as future managers. The results show that the stakeholders' perspective deserves a huge attention for those students considering what the keys of business success are. Significant differences in perception were nevertheless identified when a multifactorial analysis was undertaken. Female students are (...) more concerned about CSR issues. The maximization of value for shareholders is less valued by second- and third-year students than by first-year ones. There has been considerable debate in legal philosophy about how to attribute purposes to rules. Separately, within cognitive science, there has been a growing body of research concerned with questions about how people ordinarily attribute purposes. Here, we argue that these two separate fields might be connected by experimental jurisprudence. Across four studies, we find evidence for the claim that people use the same criteria to attribute purposes to physical objects and to rules. In both cases, purpose attributions appear to (...) be governed not so much by original intention or by moral value as by current practice. We argue that these findings in the cognitive science of purpose attribution have implications for jurisprudential questions involving purposivist legal interpretation. (shrink)

But experiences exhibit generality too: when you look at a distinct but qualitatively identical object, things seem the same to you as they did in seeing the first object. Naïve realist accounts of visual experience have often been thought to have a problem with each of these observations. It has been claimed that naïve realist views cannot (...) account for the generality of visual experiences, and that the naïve realist explanation of particularity has unacceptable implications for self- knowledge: the knowledge we have of the character of our own experiences. We argue in this paper that neither claim is correct: naïve realism can explain the generality of experiences, and the naïve realist explanation of particularity raises no problems for our self-knowledge. This paper investigates the implicative conditional, a connective intended to describe the logical behavior of an empirically defined class of natural language conditionals, also named implicative conditionals, which excludes concessive and some other conditionals. The implicative conditional strengthens the strict conditional with the possibility of the antecedent and of the contradictory of the consequent. $${p\Rightarrow q}$$ p ⇒ q is thus defined as $${\lnot } \Diamond {(p \wedge \lnot q) \wedge } \Diamond {p \wedge } \Diamond {\lnot q}$$ ¬ ◊ (...) ( p ∧ ¬ q ) ∧ ◊ p ∧ ◊ ¬ q. We explore the logical properties of this conditional in a reflexive normal Kripke semantics, provide an axiomatic system and prove it to be sound and complete for our semantics. The implicative conditional validates transitivity and contraposition, which we take to be integral parts of reasoning and communication. But it only validates restricted versions of strengthening the antecedent, right weakening, simplification, and rational monotonicity. Apparent counterexamples to some of these properties are explained as due to contextual factors. Finally, the implicative conditional avoids the paradoxes of material and strict implication, and validates some connexive principles such as Aristotle’s theses and weak Boethius’ thesis, as well as some highly entrenched principles of conditionals, such as conjunction of consequents, disjunction of antecedents, modus ponens, cautious monotonicity and cut. It is argued, on the basis of new counterexamples, that neither knowledge nor epistemic justification (or epistemic rationality ) can reasonably be thought to be closed under logical implication. The argument includes an attempt to reconcile the fundamental intuitions of the opposing parties in the debate.

Merleau-Ponty, por sua vez, descreve na Fenomenologia da Percepção que o conhecimento é, antes de tudo, uma intencionalidade corporal intraduzível em termos proposicionais. Mais tarde, em What Computers Can’t Do, Hubert Dreyfus usa a obra de ambos para apontar os equívocos do paradigma cognitivista, isto é, a abordagem dominante do então nascente campo da inteligência artificial. Finalmente, em The Embodied Mind: Cognitive (...) Science and Human Experience, a noção de enativismo - elaborada por Francisco Varela, Evan Thompson e Eleanor Rosch - surge como uma tentativa de tomar do cognitivismo e do conexionismo a hegemonia nas ciências cognitivas. O objetivo deste trabalho é apresentar as diferentes posturas didático-pedagógicas dos professores pré-serviço de língua inglesa, quando tiveram que criar tarefas utilizando diferentes artefatos de ensino (tecnologias). A necessidade de se usar a tecnologia como recurso para o processo de ensino-aprendizagem de língua estrangeira, vem proporcionando a realização de trabalhos invest-igativos concernentes a observação de formas apropriadas para utilizá-la na educação. Warschauer e Healey (1998) e Nardi (1996) defendem que a inserção dos computadores e da internet no processo de ensino-aprendizagem (...) de línguas estrangeiras está proporcionando melhor condição de trabalho, bem como, uma formação adequada aos sujeitos envolvidos com a educação. Desta forma, pesquisar sobre a inserção do computador e da internet, como recurso de material didático (apoio) tendo como base os preceitos da Teoria da Atividade (Engestrom, 1987), nos permite compreender as alterações no sistema de atividade a partir dos diferentes artefatos utilizados. Tendo como contexto de pesquisa o curso de letras de uma universidade federal, os dados foram coletados por meio de observações das aulas de metodologia. A análise dos dados mostrou que na tentativa de se criar tarefas pedagógicas, utilizando diferentes artefatos de ensino, o professor pré-serviço desenvolveu práticas diferentes. (shrink)

La “muerte” de la metafísica de la causalidad, con Kant, propició la transferencia de este Absoluto a una obligación moral, cuya legisladora sería una buena voluntad subjetiva, introduciendo el relativismo en el pensamiento humano y generando, a lo largo del tiempo, una crisis ético antropológica y la pérdida (...) de la auténtica trascendencia. ¿Sería el rescate de la metafísica una respuesta transcendental a la crisis del hombre contemporáneo? Higher courts sometimes assess the constitutionality of law by working through a concrete case, other times by reasoning about the underlying question in a more abstract way. Prior research has found that the degree of concreteness or abstraction with which an issue is formulated can influence people's prescriptive views: For instance, people often endorse punishment for concrete misdeeds that they would oppose if the circumstances were described abstractly. We sought to understand whether the so-called ‘abstract/concrete paradox’ also jeopardizes the consistency (...) of judicial reasoning. In a series of experiments, both lay and professional judges sometimes reached opposite conclusions when reasoning about concrete cases versus the underlying issues formulated in abstract terms. This effect emerged whether participants reasoned with broad principles, such as human dignity, or narrow rules, and was largest among individuals high in trait empathy. Finally, to understand whether people reflectively endorse the discrepancy between abstract and concrete resolutions, we examined their reactions when evaluating both, either simultaneously or sequentially. These approaches revealed no single pattern across lay and expert populations, or exploratory and confirmatory studies. Taken together, our studies suggest that empathic concern plays a greater role in guiding the judicial resolution of concrete cases than in illuminating judges' professed standards—which may result in concrete decisions in violation of their own abstract principles. I propose and defend a proof-based account of legal exceptions. The basic thought is that the characteristic behaviour of exceptions is to be explained in terms of the distinction, relative to some given decision-type C in some decision-making context, between two classes of relevant facts: those that may, and those that may not, remain uncertain if a token decision C is to count as correctly made. The former is the class of exceptions. A fact F is an exception relative to (...) some decision-type C, I claim, if (i) the ascertainment of F is sufficient for a token decision C not to count as correctly made, and (ii) the ascertainment of the negation of F is not necessary for a token decision C to count as correctly made. I also recuperate, reconstruct and discuss some of HLA Hart’s early views on defeasible judicial decisions. These two projects are closely connected: the latter is a vehicle for the former. (shrink)
